LICENSE PREFERENCE
TYPES OF LICENSE
NON EXCLUSIVE: A non-exclusive license is where you choose an existing design from my portfolio to be manufactured by the printer of your choice, and sold as finished goods in ONE product category. The design may also be licensed non-exclusively to other companies at the same time and will remain for sale on sites such as Spoonflower, where other people may purchase the design printed onto fabric, wallpaper and other products. I retain the copyright.
EXCLUSIVE: Usage terms for an exclusive license are negotiated and agreed upon by all parties before any design work commences. An Exclusive Licensing Agreement is drawn up to document how the design may be used, which is signed and dated by all parties. As the designer, I retain the right to use the design during the licensing period for any other purpose not specified in the licensing agreement (for example, if you have exclusively licensed a design in the product category of Wallpaper, I may also license the design within a different product category such as Baby Goods or Women’s Apparel).
Leading up to the expiration of the licensing period, you will receive first option to renew the design. If you choose not to re-license the design, the right to use the design within the specified category reverts back to me as the designer.
ANY OTHER INFORMATION:
- Do you already have a standard contract for licensing artwork?
- In which countries would the products using my design be sold?
- Is there a Lead Time (if known and important, please indicate the date you need the design file by) ?
- Anything else you'd like to mention...
WHO OWNS THE COPYRIGHT AND/OR THE DESIGN?
As the designer, I retain all copyright and ownership of the artwork and all derivative works at all times.
